1. The Promotion

1.1 By participating in the Anchoridge Stamp Duty Promotion (Promotion), you are deemed to have read and accepted these Terms and Conditions. If you do not agree with these Terms and Conditions, you should not participate in the Promotion.

1.2 The promoters are APD Coast Pty Ltd ACN 621 485 907 and APD Projects Pty Ltd ACN 160 512 452 (Promoter).

1.3 The Promotion closes on Monday, 30 September 2019 at 11.59pm AEST.

1.4 The Promoter reserves the right to extend the Promotion period at its sole discretion past 30 September 2019.

2. Conditions of Entry

2.1 To be eligible to enter this Promotion, an individual must be a resident of Victoria, Australia and aged 18 years or over. Employees, directors and other representatives of the Promoter are ineligible.

2.2 Incomplete entries may be deemed to be invalid at the discretion of the Promoter.

2.3 There is a limit of one (1) entry per person, per purchase.

2.4 The Promoter is not responsible or liable for any attempted entries that are not received for any reason, illegible entries, incorrect transcription of entry information, technical failures of any kind in relation to entry to the Promotion, the unavailability of any service in relation to entry to the Promotion, third party interference and technical or human error in relation to the administration of the Promotion. Late entries will not be accepted.

3. Eligibility

3.1 To be eligible for the Promotion, you must:

(a) sign a contract of sale (in the form to be provided by the Promoter) for a block of land at a lot within the Anchoridge Development in Armstrong Creek prior to Monday, 30 September 2019 at 11.59pm AEST (Contract of Sale);

(b) have completed the cooling off period under the Contract of Sale prior to Monday, 30 September 2019 at 11.59pm AEST, or if the day of sale pursuant to the Contract of Sale is 30 September 2019, have waived your rights to the cooling off period;

(c) if the Contract of Sale is signed on 30 September 2019, the vendor may, in its sole discretion, allow the cooling off period to apply to the sale. If vendor exercises its discretion in this regard, the purchaser agrees the cooling off period cannot be extended past 5.00pm 4 October 2019;

(d) not require approval from the Foreign Investment Review Board for your purchase of the lot and to complete settlement of the Contract of Sale;

(e) are the first purchaser of the lot and have not nominated the lot to a subsequent purchaser, unless the nomination is required to add your spouse or domestic partner as a joint proprietor of the lot;

(f) comply with all terms and conditions set out in the Contract of Sale at all times prior to settlement; and

(g) complete settlement in accordance with the terms and conditions set out in the Contract of Sale.

3.2 An individual purchasing a lot in accordance with clause 3.1 of these Terms and Conditions by way of a house and land package through a builder is not eligible for the Promotion.

4. Stamp Duty Reimbursement

4.1 If you meet the eligibility requirements set out in these Terms and Conditions, the Promoter shall provide you with a reimbursement in an amount equal to the stamp duty payable by you to the State Revenue Office under this Contract of Sale less any stamp duty exemption, concession or reduction you are entitled to (Rebate).

4.2 If you are a first home buyer and eligible for a full stamp duty exemption or concession, the Promoter agrees to pay to you an amount equivalent to the stamp duty payable by you as if the exemption or concession did not apply

4.3 The Promoter will arrange for the Rebate to be paid to you upon settlement of the Contract of Sale.

4.4 The Rebate is subject to these Terms and Conditions.

4.5 The Promoter is not required to make any alterations to the Rebate.

4.6 Subject to 3.1(d) above, the Rebate is not transferable to another person or entity, including by way of assignment or a nomination of a substitute or additional transferee.

4.7 Upon request either before or after settlement of the Contract of Sale, you must provide to the Promoter or the Promoter’s representatives evidence of the stamp duty amount payable by you in relation to the purchase under the Contract of Sale including providing a copy of a valid Duty Statement submitted by you or on your behalf to the State Revenue Office of Victoria.

5. General

5.1 To the extent permitted by law, the Promoter excludes all liability for any personal injury, loss or damage in any way arising as a result of receiving the Rebate or any aspect of the Rebate.

5.2 The Promoter expressly denies and excludes all representations about the Rebate, except as set out in these Terms and Conditions.

5.3 You must not use the Promotion in conjunction with any other promotion or offer in respect of the Anchoridge Estate in Armstrong Creek, Victoria.

5.4 The Promotion shall be governed by the laws of Victoria, Australia.
